Who should supply the Driver's Emergency Instructions in Writing? (Tremcard)

In ADR 2009 Chapter 5.4.3.2 the responsibility for supplying the Emergency Instructions in Writing changed to the Carrier (previously with the Consignor) and it now only requires to be in a language the driver / crew understand.

The format of the Instructions was also changed and one four page document now replaces the need for different cards for each product carried. (TREMCARD)

The Carrier should ensure that the drivers concerned understand and are capable of carrying out these instructions properly. Having a current ADR vocational certificate will in part achieve this, however the Carrier has to ensure the vehicle is properly equipped so that the driver can carry out the instructions.

The driver is responsible for reading and understanding the instructions and keeping them readily available in the drivers cab. He or she is also expected to carry out the emergency instructions in the event of an emergency but not to put his or her life at risk.

The Consignor may enter into an agreement with the Carrier and supply the emergency instructions to the driver on his behalf, however this does not relieve the Carrier from his legal duty to ensure the driver has these instructions and that their content is correct.
